1. Introduction & Acceptance of Terms

Virtus Machine Works, LLC is a custom metalworking business based in Arlington, TX. We design and handcraft premium divot tools and related accessories.

By visiting our website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or place an order. We reserve the right to update these terms at any time; the most current version will always be posted on this page with the date of last revision.

2. Products & Custom Orders

All Virtus Machine Works products are handcrafted in small batches using solid brass and premium materials. Because each item is made by hand:

  • Slight variations in finish, weight, texture, or engraving depth are inherent to the custom manufacturing process and are not considered defects.

  • Product photos on our website are representative. Your item may differ slightly in appearance while meeting the same quality standard.

  • We reserve the right to decline or cancel any order at our discretion, in which case you will receive a full refund.

3. Pricing & Payment

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. The price shown at the time of checkout is the price you will be charged.

  • Accepted payment methods: All major credit and debit cards, Apple Pay, Google Pay, and Link by Stripe. 

  • Payment is collected in full at the time of order placement.

  • Sales tax will be collected where required by applicable law based on your shipping address.

  • We do not store your full credit card number. Payment processing is handled securely by Squarespace Payments and is subject to their terms of service.

4. Shipping Policy

We ship from Bozeman, MT. All orders are shipped via USPS & UPS unless otherwise specified.

  • Estimated domestic delivery: These time frames are generated by and subject to USPS and UPS. 

  • Orders are considered fulfilled and our shipping obligation complete once the package is handed to the carrier and a tracking number is issued.

  • We are not responsible for delays caused by the carrier, weather, customs, or other circumstances outside our control.

  • Packages lost or damaged in transit: please contact us within 14 days of the expected delivery date. We will work with the carrier to file a claim and, where applicable, send a replacement or issue a refund.

  • International orders: all customs duties, import taxes, and brokerage fees are the sole responsibility of the buyer. We are required by law to declare the full value of goods on customs forms.

  • We are not responsible for packages delivered to an incorrect address provided by the customer. Please double-check your shipping address before completing your order.

5. Returns & Refunds

All Sales are Final

All Virtus Machine Works products are limited-edition, individually numbered collectibles handcrafted in small runs. Because each item is a unique, serialized piece - stamped with its specific number out of the total edition size - we are unable to accept returns or exchanges and do not offer refunds for any reason other than those described below.

By completing a purchase, you acknowledge and agree that the sale is final.

Defective or Damaged Items

We stand behind the quality of our work. If your item arrives with a manufacturing defect or is damaged in transit, please contact us at info@virtusmachineworks.com within 14 days of delivery. Include your order number and clear photographs of the issue.

At our sole discretion, we will either repair the item, replace it with another numbered piece from the same edition (subject to availability), or issue a full refund including any shipping costs. We will not be responsible for damage resulting from normal wear, misuse, or modification of the product after delivery.

Order Cancellations

Orders may not be cancelled once placed, as production begins promptly upon order confirmation. Please review your order carefully before completing your purchase.

6. Warranty & Limitation of Liability

Virtus Machine Works warrants that each product is free from defects in materials and craftsmanship at the time of delivery. This warranty does not cover:

  • Normal wear and tarnish from regular use.

  • Damage caused by misuse, modification, accident, or improper care.

  • Cosmetic variations inherent to handcrafted brass items (see Section 2).

To the fullest extent permitted by applicable law, our total liability for any claim arising from a purchase is limited to the amount you paid for the item in question. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

7. Intellectual Property

All content on the Virtus Machine Works website—including product designs, photographs, logos, graphics, and written copy—is the exclusive property of Virtus Machine Works and is protected by applicable copyright and trademark laws.

  • You may not reproduce, distribute, display, or use any content from this website for commercial purposes without our prior written permission.

  • Personal, non-commercial use (e.g., saving a photo for your own reference) is permitted.

  • The Virtus Machine Works name, logo, and product designs may not be used without our written consent.

8. Privacy Policy

What we collect

When you place an order or contact us, we collect:

  • Contact information: name, email address, phone number (if provided).

  • Shipping address.

  • Payment information: processed and stored by our payment provider ([Stripe / PayPal]). We never see or store your full card number.

  • Order history and correspondence with us.

  • Website usage data: IP address, browser type, pages visited (via cookies and analytics).

How we use your information

  • To process and fulfill your order.

  • To send order confirmations, shipping notifications, and customer service responses.

  • To improve our website and products.

  • To send occasional marketing emails, only if you opt in. You may unsubscribe at any time.

We do not sell your personal information. We share data only with:

  • Shipping carriers (name and address, to deliver your order).

  • Payment processors (Squarespace Payments), subject to their own privacy policies.

  • Analytics providers (e.g., Google Analytics), in aggregated, anonymous form.

9. Governing Law & Disputes

These Terms and Conditions are governed by the laws of the State of Montana, without regard to its conflict of law provisions.

In the event of a dispute, we ask that you contact us first so we can attempt to resolve the matter in good faith. If a resolution cannot be reached, disputes will be subject to binding arbitration in Gallatin Valley County, Montana, or, where required by law, in the appropriate court of competent jurisdiction.

You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.
